The only allowable placement fee is the first-month salary. There are some cases when charging for placement fee is not even allowed. You can sign these fees but only after signing an employment contract. You also need to ask for an official receipt where the total amount paid by you is written.

It’s also important to note that real agencies won’t ask for immediate payments of the airfares, intended visa, and processing costs. You can pay this after you have a job offer.

5. About Working Visa

Getting a work visa or permit is a prerequisite for getting job offers. 100-Days Maternity Leave with Pay Approved by the Congress

Recently, the House Bill No. 4113 had passed the final reading in the Congress with 191-0-0 votes. This proposed bill that increases the number of paid 100-days maternity leave of working women will be forwarded to the bicameral conference committee.

In case that this House Bill will be approved into law, both the government and private sector will benefit from it. The current paid maternity leave is 60-days and once approved, women workers will enjoy additional of 40-days.

This bill was drafted by both the House of the Representative and the Senate. The main objective of this bill is to allow the mother to spend extended quality time with the newborn. It will also give time to the mother to be fully recovered after giving birth. The authors of this bill emphasized that such period is significant for the baby and the mother.

According to Herrera-DY, the chairperson of the House Committee on Women and Gender Equality, the House Bill 4113 will cover all working women regardless of the status. It is also applicable whether for miscarriage or childbirth.

However, in spite of the willingness to help, the benefit of this bill is only applicable up to the fourth pregnancy. This means that on the fifth pregnancy, the 60-days paid maternity leave will apply. Additionally, Rep. Edcel Lagman had proposed an amendment to penalize employers that will discriminate against women.

How to Withdraw your Pag-IBIG Funds Contributions

Are you a member of Pag-IBIG or the Home Development Mutual Fund? Good news because the agency gave assurance that the members can withdraw or refund the TAV or the total accumulated savings. The TAV is consists of the member’s total annual dividend earnings, employer counterpart share, and the monthly savings.

However, before you can make your withdrawal of your Pag-IBIG Funds Contributions make sure that you qualify the criteria and the requirements for claim.

Membership maturity

To qualify for the TAV’s refund, the member should have 240 monthly contributions. However, for POP or Pag-IBIG Overseas Program members, the maturity of membership is either five, ten, fifteen, or twenty years.

Permanent Insanity or Total Disability

If the member is suffering the following cases of disabilities:

  • If the disability lasts for over 120 days
  • Complete loss of sight (both eyes)
  • Permanent complete paralysis of both limbs
  • Loss of both the limbs or if amputated above the wrist or ankle
  • Brain injury resulting to insanity or permanent imbecility
  • If the total disability is pronounced by a licensed physician

Retirement

The member has retired from work upon reaching the age of 65 or a minimum of 45 years old. He or she can opt to make refunds upon actual retirement for GSIS, SSS, or other retirements/provident plan.

Termination from work due to health reason

A member who was terminated from work due to health reason is qualified to apply for a refund of TAV from Pag-IBIG Fund.

Death

If the member dies, the benefits will be among the legal heirs pursuant to the New Civil Code.

Basic requirements for making a claim for Pag-IBIG Funds Contributions

  • Fill out the Application for Provident Benefits Claim
  • Valid ID card (with signature and photo) and the member’s Pag-IBIG Transaction Card
  • Government employees must present the Service Record
  • For members of the AFP, a Statement of Service is required

Additional requirements may be requested for the following conditions:

If the member dies, additional requirements should be presented including the following:

  • Death certificate issued by PSA or NSO
  • The acknowledged legal heirs should present the notarized Proof of Surviving Legal Heirs
  • All the children acknowledged must present certified true copy of birth certificate issued by the PSA or baptismal or confirmation certificate
  • The claimant is required to submit the following:
  • Member’s/claimant’s PSA issued birth certificate
  • Member’s/claimant’s baptismal or confirmation certificate
  • A certificate of no marriage or CENOMAR should be presented if the member is single
  • If married, a Marriage Contract of the member should be submitted

If the reason for claiming the refund is due to permanent total disability due to a health condition, the member is required to present the medical or clinical abstract as well as the physician’s certificate.

In case of retirement, the following documents should be presented:

  • Birth certificate issued by PSA/NSO ( certified true copy)
  • Certificate of Early Retirement ( private employees should have rendered at least 45 years)
  • A government employee must submit the GSIS Retirement Voucher
  • For members of AFP, must submit Order of Retirement
  • In case there’s no available birth certificate, the member must present notarized Joint Affidavit of Two Disinterested Persons and certified true copy of Non-Availability of Birth Record

If the member will migrate to another country, the following should be presented:

  • Sworn Declaration of Intention to Depart from the Philippines Permanently (notarized)

Photocopy of passport along with either the Residence Visa/Immigrant Visa/Settlement Visa or any of its equivalent

Many people in the Philippines resorted to borrowing money to make both ends meet. This is very common especially if a financial emergency happens days before the next payday. In case that it is impossible to borrow from relatives and friends, the last option is to apply for a cash loan from lenders.

The minimum amount of loan that a borrower can obtain is Php3, 000 to Php5, 000. But, the approval of the loan application also depends on the capability of the borrower to repay. In fact, there are instances in which the lender was unable to collect the borrowed amount completely.

To protect the lenders from uncollected debts, the Supreme Court has been pushing the revised small claims procedure. This will enable the lender to collect the debt payments without filing a criminal case for non-paying borrowers.

However, this new system is giving the right to the lender to file a civil case in the municipal or metropolitan court against the offenders. Under the Simple Claims procedure, the filing fee is affordable as compared to filing a criminal case. If the complainant does not have the capability to pay the fee, he or she may be exempted.

According to Chief Justice Maria Lourdes Sereno, the Small Claims is an affordable way to obtain justice. But, it does not require a lawyer’s assistance if the borrowed amount is lesser than Php200, 000. The complainant is required to pass the required documents and fill out the form.

The coverage of the Small Claims procedure includes debt, loan, mortgages, services, and rent. Once the complainant had filed the case in the municipal court, the defendant will be informed and required to answer the complaint within 30 days.

In 2016, almost 13,000 cases filed for small claims were solved.

Failure to give child support due to relationships end up well. There are instances that relationships still fail even after the couple already spent years together bind by marriage. Breaking off a relationship is worse for those with children. When a couple finally decided to put an end to the relationship, the ones that suffer and affected the most are the kids. After separation, the kid is usually left to the custody of either of the couple, most likely with the mother.

Raising a kid would be pretty costly. There will be educational, medical, and daily expenses. If a single parent is not financially capable, or even if she is, she can claim for financial support in order to make sure that the child’s needs are met.

Child Support in the Philippines

In the Philippines, there is a law that covers single parents who want to ask for financial support from their spouses. A list of parent’s responsibilities and the persons they will be responsible for are listed Under Republic Act 193 to 222. Under the family code, children whether a legitimate child or not has the right to receive a financial support until they reach the working age of 19.

It does not matter whether the parents are married or not. It is a parent’s responsibility to provide support to their kids.

But how can a single parent possibly claim a financial support?

As mentioned above, even if the couple is not married, already divorced or has put an end to the relationship, they cannot get away from the responsibility stated in the law.

This only means that a father cannot just run away from the responsibility. In case they do, the mother can seek guidance and assistance from legal practitioners or lawyers. This, however, will entail massive legal fees. Those who do not have enough means to pay for an attorney can take advantage of the service offered by the government agencies. Agencies that offer help for free or lower fees include the Department of Justice (DOJ), Public Attorney’s Office, and even from DSWD.

After filing a case, they will issue a protection order for the children involved. Usually, it means that the kids will have to remain under the mother’s custody during the case’ duration.

If you are going to make a claim, you will need to prepare a PSA Birth Certificate for your children or child and a PSA Marriage Certificate. That’s the basic documents you will need.

The failure to provide child support may be subject to certain penalties as per the new House Bill that has been passed. The penalties are applicable if the financial support amount is more than thirty thousand pesos or if the parent misses about six months of child support.

Children deserve all the love and care they can possibly get. They should not suffer the consequences of failed relationships. So every single parent should consider making a claim. Besides, it is the right of the child. Don’t be afraid to get one. The government got your back.
