Maiden Name Act – Married Women to Retain and Use their Maiden Name

Maiden Name Act – Married Women to Retain and Use their Maiden Name

In the past, once a woman gets married, she will carry her husband’s surname until the end of time. But those times have passed because nowadays, couples separate easily and have their marriage nullified. When this happens, the woman would want to carry her maiden surname instead. As everyone might have noticed though that women still use the surname of their husbands because it is still dictated by law

Good news is; Senator Binay and Congresswoman Gloria Macapagal Arroyo had filed separate bills in the Senate and Congress allowing women to drop the surnames of their husbands. CGMA filed the bill to seek women empowerment and enable women to use their maiden name even without having to undergo court proceedings.

House Bill No. 6082 which is called “Reversion to Maiden Name Act”, will allow a woman to drop the husband’s surname after nullity of marriage, divorce in another country, and legal separation with just an administrative process through the Office of the Civil Registrar. CGMA’s bill eliminates the expensive and tiring process of court procedures.

These are the situations that allow a woman to use her maiden name again;

  • Court declaration of Legal Separation with no interest of reconciling with partner
  • Annulment
  • Court decision declaring property separation
  • If the petitioner has been abandoned or separated from husband for not less than ten years
  • The husband had been presumed dead pursuant to the conditions, circumstances, and period that have been stated in the Rules of Court and the Civil Code of the Philippines. The bill furthermore grants the Department of Justice, Office of the Supreme Court Administrator, Civil Registrar General, and Department of Foreign Affairs the power to set the guideline and rules for the implementation of this matter.
  • If it was predetermined in the marriage settlement that the separation of their properties will be administered in the property relations

Senator Binay has also filed a similar bill on August 7, 2017; Senate Bill No. 1547 or will be known as Reversion to Maiden Name Act.

What is the Alternative Learning System or ALS is All About

What is the Alternative Learning System or ALS

It is said that education is the best legacy that parents can provide to their children. But not all parents have the capability to send their children to school. Thus, resulted in being out-of-school. The good thing is that the government has been implementing the Alternative Learning System or ALS.

What is the importance of the Alternative Learning System?

The implementation of the Alternative Learning System is a way that the government wants to help many Filipinos to access educational opportunities. Apparently, there are many Filipinos who were not able to finish basic education due to personal or economic constraints.

How does Alternative Learning System work?

The Bureau of Alternative Learning System offers two major programs such as the Continuing Education Program – Accreditation and Equivalency and the BLP or the Basic Literacy Program.

A&E program

The A&E program caters individuals who did not complete the elementary and high school level. The lessons are given in modules making it flexible and suitable to the individual needs of the students. After completing the programs, an accreditation and equivalency test is required. If the students have passed the test, a diploma or certification is given that they can use in case they want to pursue higher studies or find work.

Basic Literacy program

This program caters not only the youth but also the adults. It develops skills in writing, reading, and numeracy.

How does ALS vary from formal school?

The main difference between the Alternative Learning System and formal education is that the learning sessions are flexible according to the availability of the students. The program uses modules taught by the mobile teachers, learning facilitators, instructional managers, or district ALS coordinator. The session is conducted in community centers, barangay halls, libraries, and even in private homes.

Other special programs

Aside from the Basic Literacy Program and the A&E program, ALS also offers other special programs that cater to different subgroups including the following:

  • Indigenous Peoples Education – This program is tailored to the tribal communities living in the provinces of Zambales, Quezon, and Ilocos.
  • Arabic Language and Islamic Values Education – Offered for Muslim migrants

Alternative Learning System for Differently-abled Persons – For people suffering from hearing disorders through sign language.

Swift Code is also called SWIFT-BIC (Business Identifier Code), BIC, SWIFT ID, or BIC Code. It has around eight 8-11 alphanumeric characters.

Swift Code is used by professionals, OFWs, and freelancers who want to send money through wire transfer. In transferring money, five things will be needed in the said transaction;

IRR for the 105-day Expanded Paid Maternity Leave

0
IRR for the 105-day Expanded Paid Maternity Leave

On May 1, 2019, the Civil Service Commission, in collaboration with the Social Security System and the Department of Labor and Employment, released the IRR for RA 11210.

This Republic Act pertains to the Expanded Maternity Leave Law. It is a privilege to working moms in both private and government sectors to enjoy maternity leave with pay. Those who gave birth starting March 11, 2019, and forward are qualified to claim the benefits. 105 days fully paid maternity leave for live birth delivery and 60 days in case of miscarriage. Additional 15 days is given if the mother is identified as a solo parent based on the criteria of RA 8972.

This Republic Act covers all working mothers regardless of the employment status, legitimacy of the child, length of service, and civil status.

How to avail Expanded Paid Maternity Leave?

Anyone who will avail the Expanded Maternity Leave benefit can enjoy it continuously. This means that the mother is required to report for work after the 105-day or the 60-day paid leave. To qualify for the RA 11210, the mother should file the maternity leave 30 days prior to the scheduled delivery date.

The female employee can opt to use the sick leave credits or avail 30 days additional leave without pay. In case the sick leave credits are consumed, she can use the vacation leave credits. The employee must submit a written notice to the employer 45 days before the maternity leave ends.

Allocation of the maternity leave

The good thing about this maternity leave is that the father can also benefit from it. Seven days of the maternity leave can be allocated to the father aside from the seven days paternity leave pursuant to RA 8187. The allocation can be given to a caregiver in case of the absence, incapacity, or death of the father. The caregiver must be a relative within the 4th degree of consanguinity.

If the mother becomes permanently incapacitated or dies, the father of the child or the caregiver can claim the maternity leave benefits if not yet commuted to cash. However, if the benefits have been claimed by the female worker, the father or the caregiver will be excused from work but without pay.
